Trump Administration may soon refuse to recognize transgender Americans.

Well so much for Trump being more LGBTQ friendly than past Republican presidents.

Courtesy of NYT:

The Trump administration is considering narrowly defining gender as a biological, immutable condition determined by genitalia at birth, the most drastic move yet in a governmentwide effort to roll back recognition and protections of transgender people under federal civil rights law.

A series of decisions by the Obama administration loosened the legal concept of gender in federal programs, including in education and health care, recognizing gender largely as an individual’s choice and not determined by the sex assigned at birth. The policy prompted fights over bathrooms, dormitories, single-sex programs and other arenas where gender was once seen as a simple concept. Conservatives, especially evangelical Christians, were incensed.

Now the Department of Health and Human Services is spearheading an effort to establish a legal definition of sex under Title IX, the federal civil rights law that bans gender discrimination in education programs that receive government financial assistance, according to a memo obtained by The New York Times.

The department argued in its memo that key government agencies needed to adopt an explicit and uniform definition of gender as determined “on a biological basis that is clear, grounded in science, objective and administrable.” The agency’s proposed definition would define sex as either male or female, unchangeable, and determined by the genitals that a person is born with, according to a draft reviewed by The Times. Any dispute about one’s sex would have to be clarified using genetic testing.

“Sex means a person’s status as male or female based on immutable biological traits identifiable by or before birth,” the department proposed in the memo, which was drafted and has been circulating since last spring. “The sex listed on a person’s birth certificate, as originally issued, shall constitute definitive proof of a person’s sex unless rebutted by reliable genetic evidence.”

Yet more progress made by President Obama that Trump feels he must erase.

You know I am a baby boomer myself, and I am well aware of how hard it can to be to change our definitions when it comes to gender.

But as part of my job I have had to deal with people, mostly young people, going through a real crisis over their gender identification.

Because of that, I have done some extensive reading on the topic, and it is whole hell of a lot more complicated than the Trump Administration seems prepared to recognize.

For one thing, the trans community has been around since essentially the beginning of time.

People tend to think of it as a relatively new phenomenon but nothing could be further from the truth.

It has just become more public and more mainstream, which should be considered a positive step.

Individuals who feel that their gender does not match their genitalia often feel that at a very young age, and then spend years attempting to understand why they are different.

The suicide rate for transgender teenagers especially is off the charts.

Acceptance and recognition of the gender that they believe best represents them is the only way to help these folks maintain a healthy mental state.

Just treating them like regular people can do wonders for their self-esteem.

Pushing them back into the closet will have the opposite effect.

Once again, America should be better than that.

Update: I feel like this belongs here.

The question that I keep coming back to over and over again is how could so many people be so easily fooled.

Oh dear. Someone please inform the country’s most famous transgender citizen and huge Trump supporter Caitlin Jenner of this. I’m sure she will ‘understand.’ She told Diane Sawyer she didn’t like Barack Obama because she ‘Believed in the Constitution.’ Laughable! President Obama was/is a strong supporter of LGBT rights … but he had a ‘D’ after his name, and Caitlin couldn’t deal with that. Well, how’s it feel now, Bruce/Caitlin???

past President Barack Obama is a “constitutional law professor”
“In 1988, he enrolled in Harvard Law School, where he was the first black president of the Harvard Law Review. After graduating, he became a civil rights attorney and a professor, teaching constitutional law at the University of Chicago Law School from 1992 to 2004.
As a constitutional lecturer and presumed legal scholar, his academic career must have crossed paths at some time with our nation’s founding document which established three co-equal branches of government, an Executive Branch, a Congress with legislative. responsibility, and a Supreme Court with top judicial authority.
‘Article 2, Section 3, Clause 5 of our Constitution requires that the president “…shall take care that the Laws be carefully executed.””

Obama still could become Chief Justice of the Supreme Court.

Roberts is only 6 years older than Obama. Not gonna happen.

        • Anonymous October 22, 2018 at 10:11 pm

Roberts could be hit by a bus tomorrow. He could have a heart attack or stroke. There are no age limits. He could develop an aggressive and untreatable cancer.

Leaving out the position of Chief Justice, RBG isn’t the only one on in years that could go soon. Clarence Thomas isn’t any spring chicken.

The important thing is to get a Democrat in the White House in 2020 and maintain that Democratic majority in the Senate so when RBG retires, Obama can take her place.

I guarantee, as the mother of a trans son, they will never go back into the closet.

“It’s worth noting that the narrow definition of sex may also have consequences for lesbian, gay, and bisexual people who are not transgender. Courts have similarly ruled that “sex” includes sexual orientation based on the Supreme Court’s precedent that discrimination on the basis of “sex” includes sex stereotyping, such as treating a woman differently because she doesn’t act womanly enough.”
