Federal appeals court has reopened Sarah Palin’s libel case against the New York Times.

She must be so happy to be back in the news again.

A federal appeals court has revived a libel suit former Republican Vice Presidential nominee Sarah Palin filed against the New York Times over an editorial linking Palin to the 2011 shooting rampage in Arizona that wounded then-Rep. Gabby Giffords and killed six others.

The 2nd Circuit Court of Appeals said a district court judge in Manhattan erred when he dismissed Palin’s lawsuit over the 2017 editorial prompted by a similar shooting attack in Virginia that badly injured Rep. Steve Scalise as he and other lawmaker practiced for a Congressional baseball game.

In a unanimous ruling, the three-judge appeals panel said U.S. District Court Judge Jed Rakoff violated procedural rules when he dismissed Palin’s suit after an initial hearing that featured testimony from Times editorial page editor James Bennet.

Bennet testified he wrote the passage into the editorial and was unaware of numerous stories in the Times and other outlets that said no connection had been established between the Arizona shooting and the cross-hairs graphic released by a Palin political committee. Rakoff said that testimony established that Palin could not prove the “actual malice” required for a public figure to win a libel case.

Holding such a hearing with live testimony at the outset of a suit is unusual. The 2nd Circuit panel decided the approach violated Palin’s rights.

I have long doubted that Palin had a case here, but with Trump’s handpicked judges infiltrating the legal system who knows if she has a chance of winning this or not?

However even if it wins Palin’s reputation has suffered irreparable damage. 

Her blood libel speech in response to news articles linking her to the Giffords shooting made her appear unhinged. (Probably because she is unhinged.)

And then all of the legal trouble that she and her family have suffered does not leave much left to resurrect.

Still I guess for a very short time her name will reappear on the cable shows that once could not get enough of her, and a weak band of supporters will rise up to defend her name as the court case plays out. 

But when all is said and done she will simply slip back into the comfortable arms of anonymity and rarely will she be thought of again. 

Just as it should be. 

Update: Sarah Palin is so happy that people are talking about her again. 

I mean not happy enough to actually write something herself, but you how busy she is. 

Obviously that was a joke.

      It’s a legal term. Discovery is the process of exchanging information with the other side before trial. There are plenty of things to criticize Palin for, but this is not one of them. It was probably written by her lawyer, anyway.

    She doesn’t have a lot of legal trouble. I think this could be a way to highlight just how biased (on both sides) MANY media outlets are. Even thought I abhorred her as a candidate, I’ve always had a soft spot for her because I at one time spoke with her mom who has been so hurt by all the slander against her family, including non-public ones. NO ONE can deny this family is yuuuuugely mentally abused and slandered. And I know Sarah relishes the day when she recounts her family’s resilience and great heart to her grandkids.

      I do not care. Politics is politics, and it was HER choice to enter into it. Alaska is free to vote for who they want but, when you hit the national stage, it’s MY vote. Don’t give me that crap about “yuuugely mentally abused and slandered.” That tribe brought it on themselves, so dysfunctional. Let her tell her story, forever the victim, going down in history as an idiot.

    Yes, I’m sure hockey moms everywhere are rejoicing that Sarah Palin just shut down the Big, Bad New York Times, but let’s everyone grab hold of their common sense for a minute. Tuesday’s ruling in favor of Palin may have been a courtroom win, but the only people who stand to gain from this absurd case are those billing by the hour to draw out the charade of Palin’s case. As we reported, the U.S. Court of Appeals for the Second Circuit reversed a lower district court’s decision to dismiss Palin’s complaint. Sure, that sounds very dramatic, but all it really means is that the lawsuit will now actually happen. At the district court level, Judge Jed S. Rakoff had conducted a preliminary hearing to see whether Palin’s complaint even alleged something that could amount to defamation. In other words, Palin got smacked down before the case even started.

    Now, the appellate court is giving her a chance to plead – and almost certainly lose – her case. The reversal of dismissal is undoubtedly a brief resurrection of the case – but it doesn’t make Palin any more likely to actually win against the New York Times.

    I can’t help but notice that Judge John M. Walker, Jr., writing for the Second Circuit, was trying to clear that up right off the bat. Judge Walker began Tuesday’s opinion by clarifying:

    This case is ultimately about the First Amendment, but the subject matter implicated in this appeal is far less dramatic: rules of procedure and pleading standards.

    The initial dismissal – and now, the reversal of that dismissal – resulted from a rather unusual path Palin’s case had taken. Palin sued after an editorial appeared in the New York Times titled America’s Lethal Politics. In the editorial, the writers analyzed the shooting in Alexandria, Virginia at a practice for a congressional baseball game. That particular shooting left four victims injured, including a Republican Congressman, Rep. Steve Scalise of Louisiana. The piece discussed the relationship between incendiary political speech, lack of gun control, and shootings like the one in Alexandria.

    The Editorial Board also drew a parallel between the Alexandria shooting and the 2011 attack on Democratic Rep. Gabby Giffords, which left six dead and more injured; it said there was a “clear” link between the actions of shooter Jared Lee Loughner (responsible for the Giffords shooting) and speech by Palin’s political action committee. The editorial claimed that Palin’s political action committee had “circulated a map of targeted electoral districts that put Ms. Giffords and 19 other Democrats under stylized cross hairs,” suggesting that the congressmembers themselves had been pictured on the map….

      I’ve always thought there was “a parallel” between Sarah Palin’s mean-spirited ad with the crosshairs and the shooting in Arizona. Just as Don the Con has fanned the flames of racism and meanness and incivility in his supporters years later, Sarah Palin was doing it back then. She was all about the guns. I’ve wondered if she’s questioned the donations to the NRA money laundering machine in 2016.

      It wasn’t the ad and the New York Times that finally silenced Sarah Palin, it was simply that the US got tired of her whining, her ignorance, and her nasty family.

    The three-judge panel of the 2nd U.S. Circuit Court of Appeals did not weigh in on the merits of Palin’s claims, but rather said the lower court erred in how it handled the proceedings before throwing the lawsuit out.

        I know of a woman who breathes very deeply when she speaks. It’s actually a bit of a turn-on. She has very beautiful diction, her sentences punctuated by the deepest “haaaaahhhhhhhhhhhh’s” I have ever heard.

    This latest development is about PROCEDURE, not about the merits of the case.

    So it’s simply back to square one. Sarah will get another hearing where the judge will not exercise common sense by trying not to waste the court’s time. A lot of time will be wasted and the result will be the same.

    Personally, I’m glad that the names of Sarah Palin and Gabby Giffords are being linked again in the media at this particular time when the so-called president is inciting gun massacres all over the country.

    Kinda O/T but another thing that irks me about Palin is this: she complained about not being invited to John McCain’s memorial service/funeral. But did Palin ever defend McCain against Trump’s nasty attacks? Even after McCain had died? Ever? Palin never used to miss a chance to mention her adoring love of McCain … until Trump was elected.
