Not since Nixon have we seen a White House work so hard to keep Congress in the dark.

In a victory for President Donald Trump, a U.S. appeals court on Friday dismissed a Democratic-led congressional panel’s lawsuit seeking to enforce a subpoena for testimony from former White House Counsel Donald McGahn.

The U.S. Court of Appeals for the District of Columbia Circuit endorsed the Trump administration’s argument that the court had no place in settling the high-stakes dispute between the executive and legislative branches of the U.S. government.

In a 2-1 decision, a three-judge panel overturned a judge’s November ruling that the House of Representatives Judiciary Committee’s April subpoena to McGahn was lawful.

I usually take great joy in mocking Donald Trump for losing virtually every court battle, but this is one that came down in his favor so it seems fair to report that.

I should also point out that what he won was the right to keep facts away from Congress so that they cannot provide oversight.

So yeah he may have won, but the American people, many of who know that he has terrible secrets to hide, definitely lost.
